Winn-Dixie Rewards Freebies Thanksgiveaway Promotion November 15, 2024 (“Promotion”) Terms

Overview: The first one hundred (100) eligible individuals who claim the Thanksgiveaway Rewards Freebies offer in the Winn-Dixie Rewards application (“App”) on November 15, 2024 can receive one (1) free offer as described in the “Prize” section below (each, a “Prize”). The Promotion begins at 08:00:00 AM Eastern Time (“ET”) on November 15, 2024 and ends when all seven hundred (700) Prizes have been claimed in the App (the “Promotion Period”). The Promotion is subject to these terms (“Terms”) and is sponsored by Southeastern Grocers, Inc. (“Sponsor”). 

Eligibility: This Promotion is open only to: (i) legal residents of Georgia, Florida, Louisiana, Mississippi, and Alabama (ii) who are at least eighteen (18) and the age of majority in their state of primary residence, (ii) are located within 50 miles of a Winn-Dixie store location (“Store”), and (iv) are a Winn-Dixie Rewards member. Membership in the Winn-Dixie Rewards program is free and subject to terms at https://www.winndixie.com/rewards-terms. Employees, officers, directors, members, managers, agents, and representatives of Sponsor, and its parents, subsidiaries, affiliates, assigns, successors in interest, and advertising, promotion, and public-relations agencies, and any other party participating in the development, administration, or fulfillment of this Promotion (the “Released Parties”), and the immediate families (defined as any spouse, partner, parent, legal guardian, sibling, child, legal ward, grandparent, or grandchild, regardless of where they reside) and members of the same household (whether legally related or not) of each such individual, are ineligible to participate or win a Prize in this Promotion. Participation in this Promotion constitutes entrants’ full and unconditional agreement to and acceptance of these Terms and the decisions of Sponsor.

• One hundred (100) free Grade A Frozen Turkey, avg pounds of 14.7, are available as Prizes in this Promotion at 8:00:00 AM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $720.30. 
• One hundred (100) free Stove Top Stuffing Mix, Low Sodium, Cornbread, Turkey or Chicken, 6 ounces, are available as Prizes in this Promotion at 9:00:00 AM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $259.00. 
• One hundred (100) free Know & Love Butter, salted or unsalted, 16 oz, are available as Prizes in this Promotion at 10:00:00 AM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $529.00. 
• One hundred (100) free SE Grocers Cranberry Sauce, jellied, 14 ounces, are available as Prizes in this Promotion at 11:00:00 AM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $177.00. 
• One hundred (100) free SE Grocers Cut Sweet Potatoes, canned, 29-40 ounces, are available as Prizes in this Promotion at 12:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $259.00. 
• One hundred (100) free Russet Potatoes, five (5) pound bag, are available as Prizes in this Promotion at 1:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $300.00. 
• One hundred (100) free Kings Hawaiian rolls, 12 count, are available as Prizes in this Promotion at 2:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $450.00. 
• One hundred (100) free Smithfield Shank Portion Smoked Ham, average pounds 8.1, are available as Prizes in this Promotion at 3:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $850.50. 
• One hundred (100) free SE Grocers Whipped Topping, Original, Extra Creamy or Light, 8 ounces, are available as Prizes in this Promotion at 4:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $179.00. 
• One hundred (100) free SE Grocers Fried Onions, 6 ounces, are available as Prizes in this Promotion at 5:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $300.00. 
• One hundred (100) free Bakery Pies, 8 inch, sweet potato pie, pumpkin, fresh baked apple, fresh baked cherry, blueberry, peach or apple pie with caramel drizzle are available as Prizes in this Promotion at 6:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $499.00. 
• One hundred (100) free Know & Love or SE Grocers can vegetables, 14.20-15.20oz, whole kernel corn, green beans, are available as Prizes in this Promotion at 7:00:00 PM Eastern Standard Time (“EST”), with an approximate retail value (“ARV”) of  $89.00. 

Total ARV of All Prizes: $4,611.80 

Odds of winning depend on number of entries received and order in which they are received.   

All Prize details not specifically stated in these Official Rules will be determined by Sponsor in their sole discretion. The Released Parties are not responsible for, and the Prize winner will not receive the difference between, the actual value of the Prize at the time of award and the stated ARV in these Official Rules or in any Promotion-related correspondence or materials. No more than the stated Prizes will be awarded. If a winner does not accept or use the entire Prize, the unaccepted or unused Prize or part of the Prize will be forfeited, and Sponsor will have no further obligation with respect to that Prize or portion of the Prize. No transfers, prize substitutions, or cash redemptions will be made, except at Sponsor’s sole discretion. Winner is strictly prohibited from selling, auctioning, trading, or otherwise transferring the right to receive the Prize, except with Sponsor’s permission, which may be granted or withheld for any reason in its sole discretion. Sponsor reserves the right to substitute any Prize or portion thereof with another Prize or portion thereof of equal or greater value for any reason, including unavailability or limited availability of the stated Prize. Each entrant waives the right to assert as a cost of winning any Prize any and all costs of verification and redemption or travel to claim the Prize and any liability and publicity which might arise from claiming or seeking to claim said Prize. 

To receive a Prize, you must log-in to the Winn-Dixie Rewards App during the Promotion Period and be one of the first one hundred (100) eligible participants to claim a Prize by clicking the ‘Rewards’ Icon on the Winn-Dixie app and activating the digital coupon using the ‘scissor’ icon or visit https://www.winndixie.com and click ‘Digital Coupons’, then click ‘Add Coupon’. Once a prize coupon is claimed it will be loaded to the Winn-Dixie digital wallet and appear under ‘My clipped savings’ and valid through November 27, 2024 at any Winn-Dixie store. Scan your Winn-Dixie Rewards app or enter your phone number on your rewards account at checkout in order for the prize to be discounted off your total purchase.  

Each winner agrees that the Prize is provided as-is without any warranty, representation, or guarantee, express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the Prize, including, without limitation, its quality, merchantability, or fitness for a particular purpose.  

Rules: Limit one (1) Prize per person, regardless of how many times you attempt to claim a Prize in the App. Attempts made by an individual to receive prizes above the stated limit by any means are void and persons engaging in such conduct may, in Sponsor’s sole discretion, be disqualified. “Entry” must take place during the Promotion Period in strict accordance with the instructions and restrictions in these Terms. For purposes of this Promotion, an “entry” is “received” when an eligible individual visits the App and claims the Prize, according to the instructions above, during the Promotion Period. Other proof of attempting to participate does not constitute proof of actual “entry” for purposes of this Promotion. Sponsor, in its sole discretion, may accept or disqualify any purported entry that fails to follow the requirements in these Terms. Those who do not abide by these Terms or the instructions of Sponsor or its representatives may, in Sponsor’s sole discretion, be disqualified and any entry by such person void. Entries that are fraudulent, forged, incomplete, late, misdirected, illegitimate, incomprehensible, or generated by automated means will not be accepted and will be void. Participation by you on behalf of any other party or participation by another on your behalf will be declared invalid and disqualified for this Promotion. As a condition of entering the Promotion, without limiting any other provision in these Terms, you consent to Sponsor obtaining and delivering your name, address, and other information to third parties for the purpose of administering this Promotion and complying with applicable laws, regulations, and rules, including, without limitation, publishing that information on a publicly available winners’ list. The personal data collected is subject to applicable data protection laws and Sponsor’s Privacy Policy (https://www.winndixie.com/about/privacypolicy). 

By participating in the Promotion (except where prohibited by law), you grant the Released Parties the irrevocable, sublicensable, absolute right and permission to use, publish, post or display your name, photograph, likeness, voice, biographical information, quotes attributable to you and any other indicia of persona (regardless of whether altered, changed, modified, used alone, or used with other material in the Released Parties’ sole discretion) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind to you, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), worldwide, without any limitation of time, and without notice, review, or approval and you release all Released Parties from any and all liability related thereto. Nothing contained in these Terms obligates Sponsor to make use of any of the rights granted herein and entrant waives any right to inspect or approve any such use. 

Governing Law/ Release/Indemnity/Limitation of Liability: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms or the rights and obligations of participants or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.  You knowingly and voluntarily submit to the personal jurisdiction of and venue in the state and federal courts in the State of Florida. You further agree that any cause of action arising under these Terms of Use shall be exclusively brought in such courts. 

You agree to release, discharge, hold harmless, and indemnify each of the Released Parties from and against any claims, damages, disabilities, attorneys' fees, and costs of litigation/arbitration and settlement, as well as any liability whatsoever, for injuries or damages of any kind sustained in connection with: (i) the Promotion; (ii) the use, acceptance, possession, misuse or awarding of the Prize(s); or (iii) any other Promotion-related activity, including, without limitation, any injury, damage, death, loss, or accident to/of person or property. 

By taking any step(s) to participate in the Promotion, you agree that, to the maximum extent permitted by applicable law: (1) any and all disputes, claims, and causes of action arising out of or connected with the Promotion, or any Prize awarded, will be resolved individually, without resort to any form of class action; (2) any and all claims, judgments, and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable; (3) under no circumstances will you be permitted to obtain any award for, and you hereby knowingly and expressly waive all rights to seek, punitive, incidental, consequential or special damages, lost profits and/or any other damages, other than actual out-of-pocket expenses not to exceed ten dollars ($10.00), and/or any rights to have damages multiplied or otherwise increased; and (4) your remedies are limited to a claim for money damages (if any) and entrant irrevocably waives any right to seek injunctive or equitable relief.
